When booking with Lauren Barnes Photography you are agreeing to meet the guidelines of this contract. 


The client(s)” shall be those persons defined in the booking form. In the following terms & conditions “the photographer” shall mean Lauren Barnes of Lauren Barnes Photography. It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. By booking with the photographer you agree to the below Terms and Conditions.


AGREEMENT TERMS & CONDITIONS

A. Session Deposit & Fees

Client agrees to pay photography a deposit fee of £50 upon booking of the shoot, this is non-refundable. The remaining balance including any travel fees must be paid for by BACS or Paypal the evening by 8pm the evening before the photoshoot.


B. Location Costs & Fees

If there are any costs/fees associated with the location the client has chosen for their session, you, the Client, will be responsible for those fees. The Photographer will not guarantee or arrange payment on any location. Travel Fees will be added at £0.45 per mile over 10 miles from Matlock, Derbyshire will be added to cover time and petrol. Any additional fees for driving time longer than 1.5 hours, will be agreed upon by the Photographer and the Client.


C. Rescheduling

People get sick, it is understandable, however if an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Failing to give 24 hours notice, will result in photographer’s desecration for canceling or rescheduling the session. Canceling the session will result in the forfeiture of the session fee. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control, however, the same courtesy will be given and as much notice as possible will be issued. We will have a conversation 48-72 hours before the shoot to discuss the day further and look at weather conditions and the current situation.


D. Re-shoots / Refunds

Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather related issues, or by not following the recommendations of the photographer. Photographer will strive to present photos that are both professional and pleasing, though is not required to cater to the specific aesthetic preferences of the Client. Photos are the artistic expression of the Photographer, and thus no guarantees or warranties can be made as to the Client’s response to final images. Therefore, the Client understands that no refunds shall be given for this reason.


E. Editing / Proofs / Images

Photographer will aim to deliver a password protected online gallery of edited proofs to the Client within 3 weeks of the Session Date, this is often sooner. These proofs are the exclusive property of the Photographer, and the Client has no right to these photos except for viewing or purchase. Client agrees not to screenshot these images for any reason. The photographer is not liable for any technical difficulties causing a delay in turnover time, following any technical the issues the photographer will have the photos to you as quickly as possible. 

After all fees have been paid in full, the Photographer will provide the client with high resolution emailed photographs of the specified images as chosen by the client.

Photographer offers standard editing services and retouching of small blemishes and of things that are not permanent. The Photographer will NOT provide editing services included, but not limited to removing freckles, changing clothing colour, thinning body parts, changing backgrounds, head swapping, etc.

The Photographer will for no reason under any circumstances release unedited jpegs or any RAW files to the client ever.

Photographer and Client agree that Photographer is under no obligation to capture any specific moment or pose during the shoot, though the Client is encouraged to submit a list of specific poses or ideas prior to the shoot if there is something particular that the Client would like. The Photographer will do her best to capture whatever is possible within the confines of the location and conditions. The client is responsible for making sure the subject is positioned in a way they are happy with if looking for a specific photo. 


F. Cheerful Cooperation

Client agrees that should the photographer feel unsafe or mistreated, or should the clients mistreat one another in any perceived manner by the photographer during any session the photographer has the right to leave the session with no further obligation to the client whatsoever, no refund will be given under this circumstance. This is set in place for both the client and the photographers continued safety and enjoyability. This “cheerful cooperation” clause ensures that the client receive the best possible work from the photographer without interference from the resulting emotions of mistreatment or unnecessary emotional strain. Kindness rules and makes the most beautiful photos, photographer may or may not issue a warning before terminating the session.


G. Archive

After three months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. It is imperative that backups are made by the client.


H. Damage

Photographer is not responsible for the damage of digital image files (USB, CD or DVD) after delivery to client, including damage caused during transit by Royal Mail. Client assumes all responsibility for the safety of all image files upon receipt.


I. Liability

Photographer is not responsible for any injuries inflicted upon any participating parties including pets. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.


J. Copyright & Penalty

The photographer retains the entire copyright of the photographer at all times throughout the world.

Where digital image files (digital downlaod, USB, CD, or DVD) of photographs have been provided to the client, as part of their collection, these photographs may be printed professionally, and displayed online, for personal use, but not for commerical use.

Client agrees not to “alter” or “edit” any image provided by the Photographer. These images are the Photographer’s exclusive property and the Client is only being given the right to print these images. Any alterations to images could result in the Photographer seeking recompense from the Client. This includes but is not limited to; instagram filters, cropping and writing on the images.

Again, Client agrees not to save photos from facebook, screenshot or save any image on their PC or Phone that they did not purchase from the photographer, these images are the sole property of the photographer and are protected under copyright laws. Saving. screen shotting or sharing of these images is theft regardless if the client is in the image the image belongs to the photographer. Client may not publish the photographers works on any print, or digital publication (like a blog or digital magazine, this is separate from personal use on social media) with or without the watermark without the express permission of the photographer, given permission the client agrees to credit the photographer for the image(s).


K. Model Release

I hereby give to Lauren Barnes Photography the absolute and irrevocable right and permission with respect to the photographs that he/she has taken of myself and/or my minor child in which he/she may be included with others:

a) To copyright the same in the photographer’s name or any other name that he/she may select;

b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade.
